This is a strange ruling.  It now makes it very possible that the guy will be acquitted.  2nd degree was always a stretch and not what was originally charged until Keith Ellison intervened.  The jury will no longer have a lesser charge to fall back on.  If more rioting was the goal this was definitely a step in that direction.  No fair jury will convict 2nd degree.......the intent to kill is clearly not there.  He should have been charged with 3rd degree manslaughter.  That would have done the trick and would have been appropriate even though he could have still been acquitted.
