You have raised a big concern I have as well.....especially with states that give illegals driver's licenses. You have to provide government-issued identification for both identity and employment status. Things like a passport, work visa, etc. These could all be easily verified by the government if they wanted to do it right. Once an employer gets the I-9 and accompanying documents it is submitted to the govt. What happens after that to verify it is anyone's guess......but whatever they do it is not working. So to the extent the employer gathers all the proper documents and submits it they should be free from prosecution. At the same time the govt should be responsible for verifying it.
But when it comes to illegal workers many of them work as day laborers paid in cash and those employers need to be prosecuted.
