Technically, people should be fired regardless of how close they are to their pension if they commit a crime or use their jobs for personal gain.  But politics being what it is these days, if someone is close to retirement, just let them retire.  They can be put out on Admin leave, so they physically leave the premises, but are still eligible to receive their retirement.
